Chapter 6 - The Fall of the Patriarch

On Friday morning, Courtroom 402 of the New York State Supreme Court was packed to capacity with corporate attorneys, press reporters, and curious onlookers.

Harold Mercer sat at the plaintiff's table, flanked by three senior partners from his defense firm. He wore an expensive navy wool suit, his silver hair neatly combed back, projecting an aura of righteous, aristocratic indignation.

Beside him sat Dr. Robert Sterling, wearing a grey suit and looking intensely uncomfortable under the bright courtroom lighting.

I sat at the defense table beside Evelyn and Marcus Vance.

When Judge Arthur Holbrook—a stern, sixty-year-old jurist known for his zero-tolerance policy regarding corporate misconduct—took his seat behind the high bench, the entire room fell dead silent.

"We are here today on an emergency petition filed by Harold Mercer seeking to invalidate the receivership agreement executed by Evelyn Mercer," Judge Holbrook announced, opening his file folder. "Plaintiff counsel, you may present your primary witness."

Harold’s lead attorney stood up, straightening his cuffs. "Thank you, Your Honor. We call Dr. Robert Sterling to the stand. Dr. Sterling will testify that Mrs. Evelyn Mercer has been suffering from documented, progressive cognitive impairment that rendered her incapable of understanding the financial documents she signed under the undue influence of her former daughter-in-law, Claire Vance."

Dr. Sterling took the witness stand, placing his hand on the Bible and swearing to tell the truth. For twenty minutes, guided by smooth, rehearsed questions from Harold’s lawyer, the doctor described a fictitious medical history, claiming that Evelyn was prone to confusion, severe memory loss, and emotional instability.

Harold sat at his table, a faint, triumphant smirk curling the corner of his thin lips. He looked across the aisle at me, his eyes full of cold, arrogant spite.

"Your witness, Mr. Vance," the judge said, looking over his spectacles at our table.

Marcus Vance stood up, but before he could speak, I touched his arm and whispered two words into his ear: "Execute section four."

Marcus nodded, stepping up to the podium holding a thick red folder.

"Dr. Sterling," Marcus began, his voice calm, conversational, almost gentle. "You claim under oath that you have been treating Mrs. Evelyn Mercer for vascular dementia at your private clinic for eighteen months. Is that correct?"

"That is correct," Dr. Sterling replied, adjusting his tie. "She was brought to my clinic privately by her husband, Mr. Harold Mercer, to avoid public speculation regarding her declining health."

"I see," Marcus said. "And did you conduct standard neurological imaging—such as MRI or PET scans—to confirm this diagnosis?"

"Of course," Dr. Sterling lied smoothly. "All clinical protocols were strictly observed."

"Fascinating," Marcus murmured. He opened the red folder, pulled out three glossy printed documents, and walked over to the witness box. "Dr. Sterling, I am handing you Defense Exhibit C. Can you read the date and location stamped on these medical billing records?"

Dr. Sterling took the pages, his eyes scanning the text. His face suddenly went pale, his breath catching in his throat.

"Read them aloud for the court, Doctor," Marcus commanded, his voice suddenly dropping its conversational tone and turning into a whip-crack of authority.

"They... they appear to be medical records from the Mayo Clinic in Rochester, Minnesota," Dr. Sterling stuttered.

"And what are the dates of those records?" Marcus demanded.

"March 14th through March 22nd of last year..."

"The exact eight-day period during which you claimed in your signed affidavit that Mrs. Mercer was undergoing neurological evaluation in your New York office," Marcus stated coldly. "And what do those Mayo Clinic records state regarding Mrs. Mercer’s neurological health?"

Dr. Sterling’s hands began to shake so violently the paper fluttered in his grip. He couldn't speak.

Marcus turned to address the bench. "Your Honor, these certified records from the Mayo Clinic demonstrate that Mrs. Evelyn Mercer underwent a comprehensive physical and neurological executive assessment last year. The results concluded that Mrs. Mercer possesses superior cognitive functioning with zero evidence of neurological degeneration, memory impairment, or vascular decline."

A loud, collective gasp exploded from the gallery.

Harold Mercer half-rose from his chair, his face turning dark purple. "That’s a lie! That’s an illegal acquisition of private medical records!"

"Sit down, Mr. Mercer!" Judge Holbrook roared, striking his heavy wooden gavel against the block. "Sit down or I will have you removed by court officers immediately!"

Harold sank back into his chair, breathing heavily, his hands clenched into tight fists.

Marcus Vance stepped closer to the witness box, leaning over the wooden railing. "Now, Dr. Sterling... let us talk about the two-point-four million dollar wire transfer made from the Mercer Family Charitable Foundation directly to your private research trust three days after you signed this false medical affidavit. Would you like to explain that transaction to the judge, or should we invite the Special Prosecutor from the Attorney General’s Fraud Unit to explain it for you?"

Dr. Sterling dropped his head into his hands. "I... I want to speak to my lawyer," he whimpered. "I was told... Harold told me it was just a civil dispute! He told me it wouldn't go to trial!"

"Your Honor!" Marcus shouted, turning back to the bench. "We request an immediate dismissal of the plaintiff’s petition, a formal referral of Dr. Robert Sterling to the State Disciplinary Board for perjury, and the immediate execution of a bench warrant for Harold Mercer on charges of witness tampering, fraud, and illegal diversion of charitable assets!"

Judge Holbrook didn't hesitate.

He struck his gavel once, twice, three times, the heavy crashes echoing through the silent courtroom like gunshot reports.

"Petition denied with prejudice," Judge Holbrook declared, his eyes burning with intense judicial fury as he looked down at Harold Mercer. "Mr. Mercer, you are ordered to surrender your passport to the clerk of the court by 3:00 PM today. This court is freezing all personal bank accounts affiliated with your name pending full criminal investigation. Officers, secure the courtroom!"
