Chapter 9 - The Legal Masterstroke

On Friday morning at 8:45 AM, the steps of the Daniel Patrick Moynihan United States Courthouse in Lower Manhattan were swarming with reporters, news vans, and federal agents.
A sleek black Rolls-Royce pulled up to the granite curb.
The flashbulbs began popping instantly—a blinding wall of white light against the gray November sky.
Luca opened the rear door.
Damian Moretti stepped out first, looking magnificent in a tailored navy double-breasted suit. He turned and extended his hand into the cabin.
Evelyn Vance stepped onto the plaza.
She wore a dark grey wool coat, her hair pinned back in an elegant twist, holding a black leather briefcase. She looked every inch a high-powered attorney standing beside the city’s most dangerous tycoon.
Together, side-by-side, they walked past the shouting press corps into the grand marble lobby of the federal courthouse.
Waiting near the elevator bank was Assistant U.S. Attorney Richard Miller—a sharp-featured man in his fifties with wire-rimmed glasses and a cold, victorious posture.
“Mr. Moretti,” Miller said, offering a tight, arrogant smile. “And Miss Vance. I see you decided to honor the subpoena. I was worried you might try to leave the jurisdiction.”
Evelyn stepped forward, standing between Damian and the prosecutor. She opened her briefcase, pulled out a thick, blue-bound legal motion, and handed it directly to Miller.
Miller frowned, looking down at the document. “What is this?”
“That, Mr. Miller,” Evelyn said, her voice clear, articulate, and echoing off the high marble walls, “is an immediate Motion to Quash Subpoena filed under Federal Rule of Criminal Procedure 17(c), combined with a formal complaint filed with the Department of Justice’s Office of Professional Responsibility.”
Miller’s arrogant smile vanished. “On what grounds?”
“On the grounds that your grand jury investigation into Pier 42 falls under the exclusive jurisdiction of the Federal Maritime Commission, not the Southern District of New York,” Evelyn explained smoothly, taking a step closer to him. “Furthermore, your office issued a material subpoena against me based on wiretap evidence gathered under a Title III authorization that expired three days before the intercept was recorded at the Obsidian Room.”
Miller’s face turned pale gray. His head snapped toward his junior prosecutor standing behind him. “Is that true?”
The junior prosecutor looked terrified, shuffling frantically through a folder in his leather bag.
“Which means,” Evelyn continued, her voice ringing with absolute, ruthless authority, “every piece of evidence gathered from that intercept is fruit of the poisonous tree. If you attempt to seat me before that grand jury today, I will file a motion for sanctions against you personally for prosecutorial misconduct before Judge Thorndike in Room 702 in twenty minutes.”
Miller stared at the young law student in front of him. He looked at her sharp, intelligent hazel eyes, her flawless posture, and the heavy stack of case law precedents cited in her brief.
Then he looked at Damian Moretti, who was standing right behind her, his arms crossed over his chest, a look of profound, terrifying pride illumination his handsome face.
Miller swallowed hard. His fingers tightened on the brief.
“The grand jury session... is adjourned,” Miller muttered through gritted teeth, turning on his heel and walking rapidly toward the elevators with his team trailing behind him in utter humiliation.
Evelyn watched them go, her chest rising and falling softly.
She turned around.
Damian was staring at her. He didn't speak. He simply stepped close, reached out with his hand, and gently ran his fingers over her cheek, his thumb brushing her lower lip.
“You just destroyed a Senior U.S. Attorney,” Damian whispered, his gray eyes shining with an emotion so deep it made her knees weak.
May you like
“I told you,” Evelyn smiled, her voice trembling with adrenaline and joy. “I’m top five percent at NYU.”
Damian pulled her into his arms right there in the middle of the federal courthouse lobby, lifting her off her feet as he kissed her deeply, indifferent to the cameras, the guards, and the entire city watching them from the plaza outside.
