Chapter 4 - The Shadow of the Court

Two weeks passed.

The storm surrounding the Palmer-Vance scandal reached a fever pitch before settling into the long, grinding gears of the American justice system.

Giselle Vance’s bail hearing had been a disaster for her family. Despite hiring three of the top defense attorneys in the state, the judge—faced with the overwhelming, clear-cut evidence of the parking garage video—denied bail, deeming Giselle a flight risk and a danger to society. She remained locked in the Henrico County Regional Jail awaiting trial on felony assault charges that carried a maximum sentence of fifteen years in state prison.

Meanwhile, in the NICU, time moved in a different metric.

Hayden Dillard was a fighter. Over fourteen grueling days, his weight crept up from three pounds two ounces to three pounds nine ounces. His lungs grew stronger, his respiratory support was gradually stepped down from a mechanical ventilator to a low-flow nasal cannula, and for the first time, Serena was allowed to hold him for hours during kangaroo care sessions.

Serena sat in the same vinyl armchair, watching the afternoon sun stream through the high window, casting warm golden light over Hayden’s face. His skin had lost its reddish, bruised tint, replaced by a healthy, soft pink.

The door to the room clicked open softly.

Dr. Albright stepped inside, carrying a small clip of paperwork, accompanied by a woman in a sharp navy blue business suit carrying a briefcase.

"Serena," Dr. Albright said warmly. "Do you have a moment? This is Victoria Sterling. She's a court-appointed family law attorney."

Serena looked up, her hand instinctively shielding Hayden’s back. "Is something wrong?"

Victoria Sterling offered a sympathetic, professional smile as she pulled up a chair. "Nothing is wrong with Hayden, Mrs. Dillard. But I am here regarding an urgent filing made this morning in the Henrico County Family Court."

Serena felt a cold knot form in her stomach. "Raymond?"

"Yes," Victoria said, opening her briefcase and pulling out a document stamped with an official court seal. "Raymond Palmer’s attorneys have filed an emergency petition for establishing paternity rights, joint legal custody, and an immediate visitation schedule upon Hayden’s release from the hospital."

Serena’s heart hammered against her ribs. "Joint custody? After what he did? After he ignored my pregnancy, questioned his paternity, and let his fiancé attack me?!"

"Take a deep breath," Victoria advised calmly. "In the state of Virginia, biological fathers have a legal right to seek custody, regardless of their past conduct, unless their parental rights are legally terminated or they are proven to be an immediate physical danger to the child."

"He is a danger," Serena said, her voice shaking with quiet fury. "Not because he would hit Hayden, but because he sees Hayden as a trophy! A way to fix his reputation! He wants to play the reformed, grieving father on Instagram so his clients don't abandon him!"

"I understand," Victoria said softly. "And we are going to fight it. But you need to be prepared. The family court judge assigned to this petition is Judge Harold Thomas. He is an old-school, traditional judge who strongly favors father's rights and joint custody arrangements."

"When is the hearing?" Serena asked, her jaw setting into a tight, hard line.

"Tomorrow morning at nine o'clock," Victoria replied. "Raymond’s legal team requested an expedited emergency hearing on the grounds that you are actively withholding his son from him while the child is in intensive care."

Serena looked down at Hayden sleeping peacefully against her chest. She remembered the cold night in the rain, remembered Raymond’s cheerful voice inviting her to watch him win, remembered Giselle’s hands shoving her toward the concrete floor.

"He thinks he can still win," Serena whispered.

"Serena," Victoria said, leaning forward, her eyes locked onto hers. "Raymond Palmer has hired the most aggressive family law firm in Richmond. They are going to paint you as an unstable, vengeful ex-wife who is using this tragic accident to alienate a father from his newborn son. They are going to come at you with everything they have."

Serena looked up, her dark eyes clear, steady, and terrifyingly calm.

"Let them try," Serena said. "I'm not the woman Raymond left in that van four months ago. I have nothing left to lose, and I will tear his life apart before I let him touch my son."
